I can't form a clear idea to create a thesis for this task…
b) How different, if at all, has the conservative legal movement (CLM) deployed the “myth of rights” to gain a durable competitive advantage over the liberal legal movement (LLM) in law?
c) What, if any, similarities or differences exist between these movement when you assessing their “politics of rights”?|||All rights are explained quite well in the constitution. But, you knew that.|||Personally, I think the American People are sick and tired of so many things, they are angry AND vulnerable and are desperately looking for answers and ways to get this country back to where it should be. And with that mindset, anyone that steps in and offers up something that even remotely sound feasible, they all join the "band wagon." But I did love the way you referred to the "myth of rights" as it truly is a myth. Oh, it sounds good and sure the constiution is an awsome thing and if followed, would truly be the solution and give us a much better country. But I agree, that will never happen as too many politicians, lawmakers and other individuals with power in our country are far too greedy and power hungry to actually share the power with "we the people." Right or wrong, I think that that is why these Tea Party group is gathering so much success at this moment. They wave their flags and quote the constitution an tell the people what they want to hear, but in the end, they are only going to control and get empowered what THEY believe and not simply take the constiuttion and apply it as written. We are only changing agendas. Sad, but true.
As far as similarities, both parties preach about our "rights" they preach about freedoms we have as Americans, they refer to the Constitution, but both see it in two different ways. So, they use the same basis with different interpretations of the same things. Freedom and our rights are whomever is speaking at the time. It is an individual thing. For example, lets take freedom of speech. Both agree we should have freedom of speech, but both differ as to how far it should go and differ in the restraints we should have as god knows, you cannot just 'SPEAK.." Oh my, that would just not be right. (By the way, I am being sarcastic.)
